Motorcyclists in a surprising number of fatal crashes in Ontario

Motorcycles, mopeds, motor scooters and motorized bicycles comprise 2% of the vehicles on the roads of Ontario. Yet, according to a study that appeared in the Canadian Medical Association Journal, these vehicles are behind 10% of all motor vehicle fatalities in the province.

From 2007 to 2013, 26,831 people were injured in motorcycle-related crashes in Ontario and then sent to the hospital. In that same time period, there were 281,826 individuals who were injured in car collisions.

Since motorcycle collisions usually cause more serious damage and injuries, such as injuries to the chest and extremities, they cost the Ontario health care system much more. In fact, their costs are six times higher than those that are associated with car crashes and 10 times higher than the ones associated with severe injuries in general. The expense related to motorcycle crashes is also five times that of motor vehicle accident fatalities.

Motorcycle crash injuries tend to be 10 times more severe than those sustained in auto accidents. Yet despite the push for improved safety measures, little progress has been made to keep motorcyclists safe. However, Ontario does mandate helmet use among motorcyclists. The same cannot be said for many of the surrounding areas.

Motorcyclists are, of course, required to follow all traffic laws. If they fail to do so and incur a personal injury as a result, they are responsible for all the expenses relating to that injury. However, if they were injured because a driver made an unsafe maneuver or was driving while intoxicated, distracted or fatigued, they may have good grounds for a claim.

Retaining legal counsel may prove beneficial. It will be necessary for plaintiffs to obtain proof of the defendant's negligence, and a lawyer may accomplish this with the help of investigators and other third parties. An attorney may then proceed to settlement negotiations.
