Mississauga pedestrian dies in hit and run, driver arrested

Ontario residents may have heard about a hit-and-run accident that occurred in Peel Region. It all began with emergency crews being called out to the intersection of Sorrento Drive and Elia Avenue, near Hurontario Street and Highway 403, at 5:10pm on May 1. The report was that a pedestrian had been struck by a vehicle.

The victim, later identified as a 75-year-old woman who was a resident of Mississauga, was taken to the hospital without vital signs. There, she was pronounced dead. Police gathered a description of the vehicle: a four-door pickup, white in colour, with a box in the truck bed and part of its licence plate reading "AV2." The roads were closed while investigators gathered physical evidence at the crash site.

In no time, police were able to recover the vehicle and arrest the driver, a 37-year-old man, holding him responsible for the victim's death due to failure to stop at the scene of the accident. The man is scheduled to appear in a Brampton courthouse for a bail hearing.

In such a case as this, the driver responsible may face not only criminal charges but also a wrongful death lawsuit. It depends on whether the woman had any family. A wrongful death lawsuit may be able to reimburse the plaintiff for any pre-death medical bills, funeral and burial expenses, and loss of consortium or support.

If the victim survives in a pedestrian accident but still incurs a personal injury, he or she may file a claim against the driver's auto insurance provider. In either case, it may be prudent for plaintiffs to seek legal counsel. It might be difficult to present a case alone when the auto insurance company will have its own legal team fighting to deny payment or to get plaintiffs to accept a low settlement.
