Car accidents: 4 hurt following accident in Ontario

Four people have been injured, two critically, following a single-vehicle crash in Mississauga on the morning of Jan. 21. Ontario police responsible for investigating car accidents have reported they believe speed may have been a factor in the single-vehicle crash, which took place on Highway 410. They have not filed charges against the driver at this time, but have reached out to the community in search of witnesses to the crash. 

According to the current report, it appears the vehicle carrying four adults was headed northbound onto an off ramp when the driver failed to properly negotiate the curve in the road. This caused the vehicle to leave the road, smash through a guard rail and roll over before coming to rest in a grassy area. The impact caused serious damage to the vehicle, and two of the occupants are believed to have been ejected from the car. 

Two people were rushed to trauma centers in Toronto with injuries described as critical. The other two individuals in the car were also taken to local hospitals, but their injuries are said to be minor. It is unknown whether the driver is among the critically-injured. Accident reconstruction is still being conducted, and as of the media report, the off ramp remains closed. 

If the driver involved in the crash was indeed speeding at the time of the accident, that individual might face criminal charges under Ontario law. Car accidents caused by negligence or recklessness are considered avoidable and therefore criminal charges are possible. However, even if no charges are filed and/or no convictions won, the other occupants of the vehicle are entitled to file personal injury lawsuits against the driver in civil court. These suits are separate from criminal charges, though some still use police evidence gathered in the criminal investigation to support related claims in civil court.
