A 19-year-old woman from Milton has lost her life following a tragic car accident in Halton Hills. Ontario provincial police responded to the accident around 1:30 p.m. the afternoon of Oct. 7. It is unclear whether police intend to file criminal charges against the driver involved in the single-vehicle crash, but the family of the deceased woman may still be in a position to pursue a wrongful death claim.
According to police on the scene, they found a sedan upside down on the side of Sixth Line in Halton Hills. It appears the driver, a 25-year-old man, may have lost control of the vehicle around 1:10 p.m., causing it to roll onto the east side of the road. His passenger, a 19-year-old woman, was pronounced dead at the scene of the accident.
The driver suffered minimal injuries and was treated and released from the hospital in the same day. Police have yet to file charges against him, but they have asked any witnesses to the crash to please come forward to police to aid in their ongoing investigation. The case will likely remain open until a cause of the crash can be confirmed.
If Ontario police find reason to do so, they may file a criminal charge or charges against the driver. Even if they do not, however, the family of the deceased woman could choose to take the case to civil court and file for wrongful death against the driver and any registered owners of the vehicle involved in the crash. Such suits do not require that criminal charges are filed, but they do require evidence of negligence on the part of the driver.
