Young driver charged in accident; wrongful death suit possible

A young driver who cannot be identified under national law has been charged in a fatal accident, according to local police. The accident took place in Caledon, Ontario, and involved a 14-year-old male. A 12-year-old female was tragically killed in the crash that reportedly involved a stolen car. If the driver is found guilty, it may strengthen any wrongful death suit the family might wish to file against the family. 

According to the accident report, the accident happened on Highway 10 about 60 kilometers northwest of Toronto. The vehicle was headed northbound around 4:00 a.m. when it suddenly moved into the oncoming lane before striking a hydro pole, a fence and a brick pillar. The 12-year-old female passenger was pronounced dead at the scene of the accident by arriving medical personnel. 

The driver sustained unknown injuries and was taken to a local hospital. Police have charged him with criminal negligence causing death, possession of stolen property over $5,000 and dangerous driving causing death. Apparently, the vehicle involved in the crash may have been stolen, but police are still investigating that possibility. The boy is not legally old enough to drive in Canada, so further charges may be forthcoming. 

The driver of the car will be charged under the Young Offender's Act, which means he will not be identified in the press. However, the family of the deceased girl may choose to file a wrongful death suit in an Ontario civil court, and the young driver's identity will be made available to the family in this case. Such a suit could be extended to include anyone with ownership interest of the vehicle.
