What you should know if you are hurt in a slip-and-fall accident

People of all ages fall, and are injured, in the Province of Ontario, each day. The locations and reasons behind these incidents vary widely depending on the specific circumstances. If the incident takes place on the property of another, because that property was not maintained the way it should have been, it may be possible to recover damages for the injuries suffered. This could be accomplished via an occupier’s liability lawsuit.

The money secured in a successful lawsuit may be to compensate for:

  • General pain and suffering
  • Loss of income
  • Prescriptions and transportation costs
  • Future loss of income

Just how much you could receive in a successful lawsuit is dependent on the seriousness of the injury, whether you did something to contribute to the accident occurring, any pre-existing conditions, your age and the impact the injury has on your life.

The owner or occupier of a property could be sued for a variety of reasons. Poor lighting, objects left on the floor and slippery floors that lead to an injury inducing accident, are several examples. So too are walkways that have not been repaired or are covered in snow and ice.

As is the case with many types of legal action, there is a specific time period in which such a claim must be filed. If the injury occurred on a piece of property owned by a municipality, within 10 days of the incident that lead to the injury, you must let that municipality know you are planning to file a lawsuit. Regardless of who owns the property, the claim must be filed within two years.

Any personal injury lawsuit has the potential to be complex. Because of this, when pursing this course of action, it is generally a good idea to seek the assistance of a lawyer. If you, a friend or a family member are victims of someone's negligence and suffering from injuries and losses, contact us to speak to one of our lawyers to know your rights and what steps you should be taking in order to protect your rights for the future.
