Fatal work accident could lead to wrongful death claim

Depending on one’s job, what a worker will be expected to do will vary widely. While some occupations are at a greater risk for a worker being hurt, few go to their jobs expecting that they will suffer a serious injury that results in their death. Nonetheless, this does happen all too frequently throughout the nation, including the Toronto area.

Several years ago a construction worker was killed in a workplace accident. At the time of the incident, the 23-year-old man was removing debris from an excavated sewer line. When a locomotive being used was disconnected from other cars to install a fresh battery, the man’s head was crushed between the locomotive and another object.

It is nearly certain that any loved ones the man had were emotionally devastated by the incident. In addition, depending on whether he provided financial support to anyone else, they may have been financially devastated as well, left unsure of how living expenses will be covered.

In situations such as these, if a person’s death is due to negligence on the part of another person or entity, it is possible that any family the person had could seek compensation for his death.
