Woman wins tort claim after terrible crash on an icy bridge

A serious car accident on an icy bridge on a snowy day in the winter in Northern Ontario is not an unusual occurrence. It's the type of thing that happens with unfortunate regularity during the harsh winters, and the main contributing factor is usually either speed, or simply poor road conditions. Recently, however, a judge found the municipality was responsible for a terrible car accident, and the victim won her tort claim.

The accident took place in Nov. 2000 on a bridge just outside of Sudbury. A woman driving a car lost control on the icy bridge and crossed over the centre line, where an oncoming school bus struck her car. The accident caused devastating injuries to the 20-year-old victim.

She took the city to court, claiming the accident was the result of poor road maintenance. Although city regulations require salting or plowing at least every two hours during a snowstorm, the bridge had not been salted for more than three hours at the time of the accident. The city countered that crew took all reasonable care to keep the road clear, but could not have known the conditions were unsafe at the time of the accident. A judge dismissed the city's argument, and awarded $12 million to the victim.
