A tort claim may be possible after a pedestrian accident

Sometimes even doing what appears to be the right thing for the situation can still lead to undesirable results. For a case in point, look no further than the Ontario woman recently injured by a vehicle as she crossed the street in a crosswalk. Depending on the circumstances of the accident, it may be that a tort claim is an appropriate course of action for her to take.

The accident happened on June 3, at 11:30 in the morning. A 70-year-old woman was attempting to cross the street near the intersection of Kingston Road and Ridgemoor Avenue. Before completing the crossing, a taxi struck the woman, knocking her to the ground. Toronto police reports the woman was in a crosswalk at the time of the accident.

Emergency responders transported the victim to hospital with life-threatening injuries. The cause of the accident remains undetermined, and police are continuing the investigation. The taxi company has not commented on the incident thus far.

Should it turn out the taxi driver caused the accident through some manner of negligence, he or she could be held responsible for what happened. An accident caused by an employee on duty can be a particularly complex matter where a tort claim in Ontario is concerned. Determining the right way to proceed with possible legal action is probably best left to a professional.
