Wrongful death possible in Ontario car accident

Rosedale was the site of a tragedy on the early morning of Sept. 5 after a single car crash claimed the life of one individual and sent several others to the hospital. Ontario police responded to the crash that killed a 38-year-old man who was a passenger in the vehicle. So far, they have not charged the driver with a crime, but even if they do not, that individual may still face a wrongful death lawsuit. 

The details of the car accident are unclear as of this report, but it has been confirmed that a single vehicle crashed into a hydro pole on Mount Pleasant Road around 2:20 a.m. The force of the impact killed a 38-year-old man who was pronounced dead at the scene. Three other people in the vehicle were reportedly injured, though the extent of their injuries was not elaborated upon in the report. 

It is unclear whether the driver of the vehicle was among the injured parties. Police have not arrested the driver at this time and are still investigating whether alcohol or drugs played a role in the crash. They have publicly stated they believe speed may have been a factor in the accident, however. Their investigation is still underway as of this report. 

If Ontario authorities determine the driver was reckless and/or intoxicated at the time of the accident, that individual could face criminal charges. Even if no charges are filed, however, the family of the deceased man is entitled to file a wrongful death suit against the driver. The injured parties are also entitled to file for personal injury. All of these suits are handled in civil court, separate from any criminal charges that may later be filed.
