Distracted driving in Ontario

It is fair to say that most people who reside in Ontario are aware that distracted driving is an activity that should be avoided. Despite this knowledge, according to the Ontario Provincial Police, distracted driving accounts for most fatal motor vehicle accidents in the province. This means it leads to more deaths than impaired driving or speeding.

According to the president and CEO of Traffic Injury Research Foundation, over the course of the last 10 years, deaths due to distraction have increased 26 per cent. In an effort to reduce the number of these incidents, the OPP routinely institutes crackdowns.

Anecdotally, there appears to be some improvement. Police report that increasingly, other drivers are trying to get others who are using their phones while driving, to stop. Also, police indicate seeing fewer people using their phone while operating a vehicle. In addition, more drivers are using a hands-free device.

This news is likely of little consolation to those who have lost a loved one as the result of a distracted driver. While there is nothing that can be done to bring that person back, it is possible a wrongful death lawsuit could, in addition to compensation, provide a sense of closure to those left behind.
