Returning to work after disability leave

Most of us rely upon a job to make ends meet. When someone becomes disabled due to injury or illness, they may be unable to work for a period of time. While in some cases the disability makes it impossible for that worker to ever return to his or her job, other times, after a period of recovery, a worker could find that he or she is ready to go back.

Recently, the Superior Court of Ontario ruled on this very topic. It determined that employees seeking to return to work must provide medical documentation that supports the individual returning to work. This ruling may help to address some of the confusion surrounding an employee’s transition. In addition to an employer being certain that individual is in fact ready top come back, it may remove the feelings of harassment and discrimination in connection with need to provide medical evidence, which some employees may have previously felt.
