Fatal January bus crash results in charges for driver

A fatal bus crash in Ontario on Jan. 14 has led to charges for the 66-year-old driver on duty that night. Of the five passengers on the bus at the time, one was thrown from the vehicle and died at the scene. The accident happened around 10 p.m. as the bus traveled toward York University on 407. The bus rolled over and a guardrail was driven through the front and down the aisle. It is expected that the diagnostic computer from the bus may show whether the driver was speeding at the time.

Reports do not yet state what is believed to have caused the accident. GO Transit buses are inspected once per shift, and the 8-year-old bus was said to be in good mechanical condition. The driver had over 15 years of experience with the company and was in the middle of his shift.

In cases like this, the family of an individual who is killed may want to file a wrongful death suit. A driver, a transportation company or a manufacturer are among the parties that might be named in such a lawsuit. In some cases, more than one party may be considered responsible.

A wrongful death suit might provide financial compensation that may cover lost income and support of dependents, among other expenses. It might be possible to name a driver in such a suit even if there are no criminal charges filed. The burden of proof in a civil case is different, and a person found not guilty in a criminal case may still be held liable in civil court.
